SpotMyGig is a booking platform that helps artists, venues, and other music professionals discover each other, send offers, negotiate details, confirm bookings, manage conversations, and handle related payments in one place. By using SpotMyGig, you agree to these Terms of Use.
1. Who may use SpotMyGig
You may use SpotMyGig only if you can legally enter into a binding agreement and your use of the platform is not prohibited by applicable law. If you create an account on behalf of a venue, company, agency, or other organization, you confirm that you have authority to act for that entity.
2. Your account
You are responsible for keeping your login details secure and for all activity under your account. The information you provide must be accurate and kept reasonably up to date, including your contact details, artist or venue identity, and any payout or billing information needed for platform features.
3. Profiles and content
You retain ownership of the content you upload or submit to SpotMyGig, such as profile images, banners, gallery media, descriptions, social links, music links, videos, pricing information, product or performance details, and messages. By submitting that content, you give SpotMyGig a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, and display it as needed to operate, improve, market, and secure the platform.
You are solely responsible for ensuring that your content is lawful, accurate, non-misleading, and does not infringe anyone else’s rights.
4. Bookings, offers, and negotiations
SpotMyGig provides tools that help users discover each other, send booking offers, negotiate terms, confirm event details, and track booking activity. Availability of artists or venues, pricing, timing, acceptance, cancellation, and performance quality remain the responsibility of the users involved in the booking.
A booking, offer, or event-related confirmation created through SpotMyGig may carry contractual significance between the participating users. You are responsible for understanding what you send, accept, reject, change, or confirm through the platform.
5. Payments, subscriptions, invoicing, and payouts
Some SpotMyGig features may require payment, an active subscription, completed billing details, or connected payout information. Billing may be handled through third-party payment providers. By using paid services, you agree to pay all applicable fees, taxes, and charges associated with your use of the platform.
SpotMyGig may suspend access to certain features if payment fails, a subscription expires, required billing details are missing, or there is a compliance, fraud, or dispute concern. Payouts may be delayed or held where reasonably necessary to manage refunds, chargebacks, disputes, risk checks, or event-related issues.
6. Acceptable use
You agree not to misuse SpotMyGig. This includes, without limitation: attempting unauthorized access; interfering with the platform; scraping or copying data in a way that breaches these terms; impersonating another person or business; sending spam; publishing false, unlawful, abusive, or infringing content; manipulating reviews, offers, or booking flows; or using the platform in a way that could harm users, events, or the reputation of SpotMyGig.
7. Moderation and enforcement
SpotMyGig may review content, profiles, bookings, payment-related events, and reports of misuse to protect users and the platform. We may remove content, restrict features, place activity under review, suspend accounts, cancel access, or take other reasonable action if we believe there is a breach of these terms, a security risk, suspected fraud, illegal activity, or harm to the platform or its users.
8. Third-party services
SpotMyGig may integrate with or rely on third-party services such as payment processors, app stores, analytics tools, music platform lookups, push notification providers, maps, and email providers. We are not responsible for third-party services, their availability, or their separate terms and privacy practices.
9. Intellectual property
SpotMyGig, including its brand, visual identity, platform design, software, workflows, and original materials, is protected by intellectual property laws. Except where these terms expressly allow it, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the platform or its protected materials.
10. Disclaimers
SpotMyGig is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we do not guarantee uninterrupted access, error-free operation, successful bookings, artist or venue performance quality, payment timing, or that the platform will always meet every business or personal need.
11. Limitation of liability
To the fullest extent permitted by law, SpotMyGig and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the platform.
12. Termination
You may stop using SpotMyGig at any time. We may suspend or terminate your access if necessary to protect the platform, enforce these terms, comply with law, or respond to risk, fraud, or abuse concerns. Any provisions that by their nature should survive termination will continue to apply, including provisions about payments, liability, intellectual property, and disputes.
13. Changes to these terms
We may update these Terms of Use from time to time. When we do, we may revise the effective date above and, where appropriate, provide additional notice inside the platform or by email. Your continued use of SpotMyGig after updated terms become effective means you accept the revised version.
